India is fast emerging as the ’surrogacy capital of the world’ with a huge business in ‘fertility tourism’. A burgeoning number of Indian women are turning to be surrogates for childless foreign couples. Fueling the surrogacy service from India are a slew of factors, including low medical costs, a highly qualified medical workforce and lax surrogacy laws.Renting of womb is legal in India but there is no law to regulate surrogacy.

The new draft Bill legalizing surrogacy in India — the Assisted Reproductive Technology (ART) [Regulation] Bill 2010 — has provided for single parenthood by allowing “unmarried couples” and “single persons” from India and abroad to have children using ART procedure and surrogate mothers.Govt proposes womb banks to legalize surrogacy in India.These ART banks will be independent of IVF clinics. Oocyte (unfertilized egg) and semen preservation will be their main focus.
By conferring the right to have children on unmarried couples and single persons, the bill attempts to achieve several historic feats – legalizing commercial surrogacy, single parenthood, live-in relationships and entitling gays and lesbians to start families using surrogate mothers – at one go.
This is a positive step in favor of choice and equality as it could open up a legal channel for anyone, irrespective of gender, sexual orientation or marital status, to start their own families. Presently there are no laws regulating surrogacy births, something that has resulted in complications in some cases.
Renting a womb could soon become a completely legal and hassle-free experience, both for Indian as well as foreign couples looking for surrogate mothers in the country.
Although Commercial surrogacy has been legal in India since 2002, as it is in few other countries, including the United States. The reasons for India emerging as a favorite destination for surrogacy are many. The country boasts the best IVF services in the world and the fact that English is widely spoken makes it easier for foreigners to avail of medical services. Moreover, it costs almost one-fifth of what it would in the West.
India has taken advantage of the medical tourism surge in general and is at the forefront of the global surrogacy market.
Gestational surrogacy, the latest trend in reproductive tourism, a sub-industry of medical tourism, has increased exponentially over the last several years as Americans, Europeans and others seek out surrogacy services abroad. Advances in assisted reproductive technology (ART) have made gestational surrogacy more viable than reproductive endocrinologists and other fertility specialists thought imaginable just twenty years ago.
In-vitro fertilization, (IVF) in which a woman’s oocyte is fertilized outside of the womb in a laboratory setting and then transferred to a gestational carrier’s uterus, has made the option of gestational surrogacy viable for women experiencing infertility, gay couples, and single men.
“This Indian surrogates are like a God to them because without them they would never had had their child,” and “The joy that is there at the end of the day is a million times more than the money you can count.”

According to the Indian Department of Tourism, the average cost of healthcare in India is about one fifth that of the West, multi-organ transplants are done for a tenth the cost in the West and there is “zero waiting time”. Fertility tourism is a very expensive treatment and specially in Western country it is highly expensive.But in India due to low cost of labour charge it is still cheaper and affordable for all.
